Terms and Conditions

The Town of Pawling, New York Web Site (referred to as the “Site” in this document) is an online information service provided by the Town of Pawling, New York (the “Town”).  Use of the Site and its services is subject to your compliance with the terms and conditions (referred to as “Terms” in this document) set forth below in addition to all applicable laws.  For the purposes of this document, the terms “Site” and “Services” may be used interchangeably to refer to the Town of Pawling Web Site and the Information, Content, and Services it provides.

Please read these terms and conditions carefully before accessing or using the Site.  By using the Site and/or Services, you agree to be bound by the terms and conditions set forth below.  If you do not wish to be bound by these terms and conditions, do not use the Site and/or Services.

  1. Accepting the Terms
    1.1. In order to use the Site, you must first agree to the Terms.  By using the Site, you implicitly accept the Terms.
  2. Provision of Site and Services
    2.1. The Town continually updates the Site in order to provide the best possible service for users.  You acknowledge and agree that the form and nature of the Site which the Town provides may change from time to time without prior notice to you.
    2.2. As part of this update process, you acknowledge and agree that the Town may stop (permanently or temporarily) providing the content and/or Services to you or to users at the sole discretion of the Town.
  3. Use of the Site and Services
    3.1. In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services.  You agree that any registration information you give the Town will always be accurate, correct, and up-to-date.
    3.2. You agree to use the Site and Services only for the purposes that are permitted by (a) the Terms and (b) any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions.
    3.3. You agree not to access or attempt to access any of the Content or Services by any means other than through the interface that is provided by the Town.  You specifically agree not to access or attempt to access any of the Content or Services through any automated means (including the use of scripts or web crawlers).
    3.4. You agree that you will not engage in any activity that interferes with or disrupts the Site (or the servers and networks that are connected to the Site).
    3.5. You agree that you are solely responsible for (and that the Town has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which the Town may suffer) of any such breach.
    3.6. You agree that you will not abuse the Site and Services, or engage in any activity that disrupts or prevents another user from using the Site and Services. In addition, your access to the Site and Services or specific areas of the Site and Services may be restricted or terminated at any time and at the sole discretion of the Site operator. This includes, but is not limited to the deactivation of any user account(s) you have registered
  4. Passwords and Account Security
    4.1. You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Site and/or Services.
    4.2. Accordingly, you agree that you will be solely responsible to the Town for all activities that occur under your account.
    4.3. If you become aware of any unauthorized use of your password or of your account, you agree to notify the Town immediately at

    4.5. You acknowledge and agree that if the Town disables access to your account, you may be prevented from accessing the Site, Services, account details, or any files or other content that is contained in your account.
  5. Exclusion of Warranties
    5.1. You expressly understand and agree that your use of the Site and/or Services is at your sole risk and that the Site and Services are provided “as is” and “as available.”
    5.2. In particular, the Town does not represent or warrant that:
    5.2.1. Your use of the Site and/or Services will be uninterrupted, timely, secure, or free from error.
    5.2.2. Any information obtained by you as a result of your use of the Site and/or Services will be accurate or reliable, and
    5.2.3. That defects in the operation or functionality of any software provided to you as part of the services will be corrected.
    5.3. Any material downloaded or otherwise obtained through the use of the Site and/or Services is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material.
    5.4. No advice or information, whether oral or written, obtained by you from the Town or through or from the Site or Services shall create any warranty not expressly stated in the Terms.
  6. Privacy
    6.1. For every visitor to our site, there are several common pieces of information that we collect that are stored in logs. Internet Protocol (IP) address, browser type, the date and time of the visit, and the addresses to which a visitor linked during a visit to our Web site are all recorded. We cannot and do not associate any of this information with individual persons, distribute this information, or use it in any manner other than for statistical analysis in improving our site to better serve our visitors.
    6.2. The Town does not use cookies to record any personal information. Cookies are used by some County web applications to pass needed information from one page to the next. Rejecting a cookie in these applications will render the application useless. Applications use cookies to track the session through randomly generated ID numbers that cannot be traced back to any personal or private information.
    6.3. The Town strives to collect the minimum amount of information from our visitors that is necessary to provide various services and resources through our online applications. The Freedom of Information Law (FOIL), however, requires the Town to share information that it has collected through its web applications with those requesting this information. There are provisions under FOIL (foil-law-text-11032023.pdf ( that allow the County to withhold certain records from a requestor.  For instance, the County will not disclose any records that constitute, by law, an unwarranted invasion of privacy; this includes communications such as those relating to public assistance programs, and personal medical or mental health matters.
  7. The Site and/or Services may include hyperlinks to other websites, content, or resources.  The Town may have no control over any websites or resources that are provided by companies or persons other than the Town.
    7.1. You acknowledge and agree that the Town is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products, or other materials on or available from such websites or resources.
    7.2. You acknowledge and agree that the Town is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy, or existence of any advertising, products, or other materials on, or available from, such web sites or resources.
    7.3. Reproduction in whole or in part of any photographs, maps, or illustrations contained on this Site without prior written permission from the Town is prohibited.
  8. Changes to the Terms
    8.1. The Town may modify these Terms at any time without specific notice to you, and such modifications shall be effective immediately upon posting of the modified Terms on the Site.  When these changes are made, the Town will make a new copy of the Terms available at Town of Pawling – Home.
    8.2. You understand and agree that if you use the Site and/or Services after the date on which the Terms have changed; The Town will treat your use as acceptance of the updated Terms.
